Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you and Firestarter ("we," "us," or "our"), concerning your access to and use of the Firestarter mobile application and website.

By downloading, registering with, or using the application, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not access or use our application.

Eligibility

The application is intended for users who are at least 13 years of age. By using the application, you represent and warrant that you meet this requirement. If you are under 18, you must have parental consent to use the application.

Account Registration

You may be required to register for an account to use certain features of the application. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your account credentials secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use or security breach

We reserve the right to suspend or terminate your account if any information you provide is inaccurate, false, or incomplete.

Required Information

To provide our core photo analysis and coaching services, we require certain personal information during account registration:

• Phone number: Required for account security, two-factor authentication, account recovery, and prevention of fraudulent accounts. This information is essential to protect your account and the personal photos you upload to our service.
• Gender: Required for our AI photo analysis algorithms to deliver accurate and relevant feedback. Our coaching services provide personalized recommendations that may differ based on gender presentation, as photographic best practices and styling recommendations can vary. This information is directly related to our core functionality of providing tailored photo analysis.

We only collect information that is necessary to provide our services. You can update your information at any time through your account settings, and you have the right to request an explanation of how your personal information is used within the app.

Account Deletion

You have the right to delete your account at any time through the app settings. Upon account deletion:

• All your personal information, including required information and uploaded photos, will be permanently deleted from our servers
• The deletion process will be completed within 30 days
• We may retain certain information as required by law or for legitimate business purposes
• You may request confirmation of deletion by contacting our support team

User Content and Conduct

When you upload photos or other content to the application ("User Content"), you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content for the purpose of providing our services to you.

You are solely responsible for all User Content that you upload and agree that your User Content will not:

• Violate any applicable law or regulation
• Infringe on any third party's rights, including intellectual property and privacy rights
• Contain any material that is defamatory, obscene, offensive, or harmful
• Contain any viruses, malware, or other harmful code
• Impersonate any person or entity

We reserve the right, but are not obligated, to monitor and review all User Content and to remove any content that violates these Terms of Use.

Intellectual Property Rights

The application and its original content, features, and functionality are owned by Firestarter and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Modify, adapt, or hack the application
• Reverse engineer or attempt to extract the source code
• Use the application for any illegal purpose
• Copy or distribute any part of the application without our permission
• Use any data mining, robots, or similar data gathering methods

Subscription and Billing

Some features of our application require a subscription. When you subscribe to our premium service:

• You agree to the pricing and payment terms presented at the time of purchase
• Subscriptions automatically renew until you cancel
• You can cancel your subscription at any time through your account settings
• We may change subscription fees upon notice to you
• Refunds are subject to our refund policy

Free Trial

We may offer free trials of our premium service. At the end of the trial period, you will be automatically billed for the subscription unless you cancel before the trial ends.

Limitation of Liability

To the maximum extent permitted by law, Firestarter shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the application.

In no event shall our total liability to you for all claims exceed the amount you paid to us in the 12 months preceding the event giving rise to the liability.

Disclaimer of Warranties

The application is provided "as is" and "as available" without any warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to defend, indemnify, and hold harmless Firestarter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your use of the application or your violation of these Terms of Use.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Changes to Terms

We may modify these Terms of Use at any time. We will notify you of any changes by posting the updated terms on this page. Your continued use of the application following the posting of revised Terms of Use means that you accept and agree to the changes.

Termination

We may terminate or suspend your access to the application immediately, without prior notice or liability, for any reason, including if you breach these Terms of Use.

Upon termination, your right to use the application will immediately cease, but all provisions of these Terms of Use that by their nature should survive termination shall survive.
